TERMS AND CONDITIONS
These terms and conditions (“Agreement”) govern your use of the services provided by Vietnam Active Adventures is owned and operated by CÔNG TY TNHH THƯƠNG MẠI BẤT ĐỘNG SẢN VÀ DU LỊCH VJN Limited Company (referred to as “the Company”) for any travel-related activities or bookings in Vietnam. By engaging in any transactions with the Company, you acknowledge and agree to be bound by the terms and conditions set forth herein.

Booking and Reservation
At the time of booking, a deposit in the amount specified per person per Tour is due to THE COMPANY. If the booking is made 60 days or less prior to departure, full payment is due at the time of booking.
Certain products or services offered by THE COMPANY may require you to make full payment at the time of booking. THE COMPANY will advise you of any such requirements prior to confirmation of the applicable booking.
If full payment is not received by the applicable due date, THE COMPANY may, at its sole discretion, change the rate payable for the booking, or treat the booking as cancelled and retain the deposit paid on booking as a cancellation fee. If a booking is made less than 60 days before the departure date of the first product included in the applicable booking, then the full amount must be paid at the time of booking. If, for any product or service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.
THE COMPANY is not responsible for any charges levied by third parties or financial institutions and payable by you because of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to THE COMPANY.
1.1. To make a booking, you must provide accurate and complete information about yourself, and any other individuals included in the booking.
1.2. All bookings are subject to availability and confirmation by the Company. The Company reserves the right to reject any booking request at its discretion.
1.3. By making a booking, you confirm that you are at least 18 years of age and have the legal authority to enter into this Agreement.

Payment
2.1. The Company accepts payment via Credit Card/Cash/Bank transfer to the provided bank account. Payment details, including the bank account name, number, currency, BIC/SWIFT code, and bank information, are specified above.
2.2. All payments must be made in Vietnam Dong (VND) as required by the Vietnam Tourism Law.
2.3. You are responsible for any additional charges incurred during the payment transaction, such as bank fees or currency conversion fees.
2.4. The Company reserves the right to modify the prices and payment terms at any time. Such modifications will not affect any bookings confirmed prior to the modification.

Cancellation and Refunds
For tour package or individual components supplied by third parties, e.g., Transport, Air Ticket, Hotel Bookings, Cruises etc. cancellation fees under the terms and conditions of the respective third party’s alternative cancellation terms may apply. THE COMPANY will advise you of any such requirements prior to confirmation of the applicable booking.
The Company reserves the right to charge a minimum amendment fee of USD $20 per person for each change to a confirmed booking. This is in addition to any fees charged by the supplier.
The Company also reserves the right to charge a cancellation fee of a minimum of USD $100 per person to cover administration expenses. For all cancellations by the Participants a cancellation fee of USD100(VND Equivalent) for all bookings will be applicable. All cancellation of booking must be made in writing or in person to avoid any misunderstanding.
3.1. Cancellations must be made in writing and sent to the Company’s email address provided above. The date of receipt of the cancellation request will determine the applicable cancellation charges.
3.2. The Company’s cancellation policy is following the Vietnam Tourism Law and is as follows:
- a) Cancellations made more than 60 days prior to the scheduled activity will receive a full refund, minus any non-refundable fees or charges by Third Party.
- b) Cancellations made between 31 to 59 days prior to the scheduled activity will receive a 50% refund, minus any non-refundable fees or charges by Third Party.
- c) Cancellations made less than 30 days prior to the scheduled activity will not be eligible for a refund.
3.3. In cases where the Company is unable to provide the booked services due to force majeure events or circumstances beyond its control, the Company will offer alternative arrangements or a refund, as deemed appropriate.
3.4. CANCELLATION OF A TOUR BY THE COMPANY
THE COMPANY guarantees that all scheduled Tour departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up to date Tour and itinerary information is available on THE COMPANY website or by contacting THE COMPANY.
If a Tour is cancelled by THE COMPANY before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from THE COMPANY:
(a) a substitute Tour of equivalent or superior value; or
(b) a substitute Tour of lesser value if no Tour of equivalent or superior value is reasonably available and to recover from THE COMPANY the difference in price between the price of the Tour originally purchased and the substitute Tour; or
(c) a full refund of all the unused money paid for the cancelled Tour.
THE COMPANY is not responsible for any incidental expenses or consequential losses that you incur because of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, THE COMPANY reserves the right to issue a full refund of the unused money in lieu of the choices above, in its sole discretion. Where a significant element of a Tour as described cannot be provided after departure, THE COMPANY will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, THE COMPANY may provide you with a refund for unused products or services as determined in its discretion.

Liability and Insurance
4.1. The Company acts as an intermediary between you and the providers of travel services, such as tour operators, transportation companies, and accommodation providers. The Company does not own, operate, or control these services directly.
4.2. The Company is not liable for any loss, injury, damage, or delay arising from the acts or omissions of any third-party service providers or any other circumstances beyond its control.
4.3. It is strongly recommended that you obtain comprehensive travel insurance to cover any unforeseen events, including medical emergencies, trip cancellations, or loss of personal belongings.
4.4. THE COMPANY decides with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (“Third Party Suppliers”) to provide you with some or all the components of your booking. Third Party Suppliers may also engage the services of local operators and sub-contractors. Although THE COMPANY takes all reasonable care in selecting Third Party Suppliers, THE COMPANY is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third-Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third-Party Supplier. YOU acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate, and THE COMPANY does not warrant that any Third-Party Supplier is following the laws of your country of residence or any other jurisdiction.
THE COMPANY is not liable and will not assume responsibility for any claims, losses, damages, costs, or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental, resulting from the act or omission of any party other than THE COMPANY and its employees.

Intellectual Property
5.1. All content, including but not limited to logos, trademarks, website design, and promotional materials, remains the property of the Company. You may not use, reproduce, or modify any of the Company’s intellectual property without prior written consent.

Governing Law and Jurisdiction
6.1. This Agreement shall be governed by and construed in accordance with the laws of Vietnam, including the provisions of the Vietnam Tourism Law. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Vietnam.

Miscellaneous
7.1. The Company reserves the right to modify or update these terms and conditions at any time. The revised terms will be effective upon posting on the Company’s website or any other communication means.
7.2. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
7.3. Validity of Prices
Prices on the Vietnam Active Adventures website are subject to availability and conditions. Although every care has been taken, the prices are not guaranteed and are subject to change without notice.
Any featured prices for a cruise or for accommodation or any other package will normally be based on a minimum of two adults sharing, unless otherwise indicated. Featured prices may be subject to port and airport taxes, plus government charges. Please ensure you are aware if such charges are included in your cruise. Please also check if gratuities are included in your cruise price.
By engaging in any transactions with Vietnam Active Adventures, you acknowledge that you have read, understood, and agreed to the terms and conditions stated above, as well as the provisions of the Vietnam Tourism Law.
